GENERAL RENTAL TERMS AND CONDITIONS FOR PASSENGER VEHICLES (AS OF: 04/26)
1. Contractual Parties and Subject Matter of the Contract
1.1 The contract is concluded between the renter and the lessor.
1.2 Based on the rental agreement, the lessor provides the renter with a non-smoking vehicle (hereinafter referred to as the “vehicle”) for a fee.
1.3 The lessor is entitled, in agreement with the renter, to repossess the vehicle at any time and replace it with a comparable vehicle, or to do so in advance, provided that it meets the specifications of the contractually agreed vehicle. The lessor is only entitled to do so in justified cases where the originally agreed vehicle cannot be provided or can no longer be used.
2. Handover of the Vehicle, Provision and Default of Acceptance by the Renter
2.1 The lessor is obliged to hand over the vehicle to the renter at the agreed time and place in a condition free from technical defects that could impair road safety. The renter is obliged to take delivery of the vehicle at the agreed time and, upon provision, to immediately check the condition and equipment of the vehicle. Any damage or defects identified must be reported and documented without delay.
2.2 In the case of short-term rentals (up to 28 days), the following provisions apply. If the renter does not take delivery of the vehicle no later than one hour after the agreed time, the reservation shall no longer be binding. Cancellations must be made at least 24 hours prior to the start of the rental period. If this does not occur, the renter shall pay the daily base rate in accordance with the price list valid at the time of cancellation, unless the vehicle could be rented out otherwise. The right to claim additional damages remains unaffected. The renter is entitled to prove that a lesser or no damage has occurred. If the lessor can demonstrate higher damages, or the renter can demonstrate lower or no damages, the amount of damages shall be adjusted accordingly.
2.3 In the case of long-term rentals, the lessor reserves the right to charge a fee of at least one monthly rental fee if the renter withdraws from an already signed rental agreement after the start of the rental. Cancellation of long-term rentals is free of charge if made up to five calendar days prior to the start of the rental period. If cancellation is made between five and one day before the start, the lessor is entitled to 50% of the agreed monthly rental fee. If cancellation occurs on the day prior to the start, on the start date itself, or if the vehicle is not collected, the lessor is entitled to 100% of one monthly rental fee. If the renter does not collect the vehicle within one hour of the agreed time, the reservation is no longer binding.
2.4 Upon handover of the vehicle, the renter must present the following documents:
• a valid driving licence for the booked vehicle class
• a valid payment method issued in their name
• a valid identity card or passport
Driving licences issued outside the EU are accepted if the customer holds a valid visa which has not expired at the time of rental (exception: Switzerland). Non-EU residents staying in Europe for more than six months must present an EU driving licence. Accepted payment methods include internationally recognised credit cards (Visa, MasterCard, American Express), whereas prepaid cards are not accepted. The payment method must be issued in the name of one of the drivers and must be valid at the time of vehicle collection. If the renter fails to present the required documents, the lessor is entitled to withdraw from the contract. In such case, the renter shall not be entitled to any claims for non-performance.
3. Authorised Drivers
3.1 The vehicle may only be driven by persons who are correctly listed as renter or driver in the rental agreement and who hold a valid driving licence at the place of rental.
3.2 In addition to the renter, the vehicle may be driven by other persons only with the express consent of the lessor. Such consent is deemed granted for additional drivers listed in the rental agreement with their full name and driving licence number. Without such consent, insurance coverage may not apply.
3.3 If an additional driver is authorised, an extra fee will be charged in accordance with the price list valid at the time of rental.
3.4 All rights and obligations of this agreement shall apply equally to authorised drivers.
4. Use of the Vehicle
4.1 Excessive wear and tear is prohibited. The vehicle may only be used on public roads in compliance with all applicable traffic regulations. The following uses are strictly prohibited: off-road driving, driving school use, driving training, motorsport activities, use on race tracks (including track days), races of any kind, participation in rallies, illegal street racing, commercial passenger transport, transport of hazardous materials, subletting, use by unauthorised drivers, use of the vehicle to commit criminal acts, use as a weapon, driving under the influence of alcohol, drugs or impairing substances, driving without a valid licence, towing vehicles or trailers. Any similar violations are subject to statutory provisions.
4.2 The renter shall bear all costs relating to tolls or fees incurred for the use of certain roads and must comply with all related obligations.
4.3 When not in use, the vehicle must be locked in all parts, and the steering lock engaged. Valuables must not be left visible in the vehicle. The renter/driver must remove keys and documents and keep them secure. Convertibles must be closed.
4.4 The manufacturer’s operating instructions must be followed, particularly regarding fuel requirements. The renter must treat the vehicle with due care, comply with operating instructions, running-in guidelines, and observe speed and rev limits. Oil, water levels and tyre pressure must be checked regularly.
4.5 The renter is not permitted to drive the vehicle into countries prohibited by the lessor. Generally, cross-border use is permitted only in the following countries: Andorra, Belgium, Denmark, Finland, France, Ireland, Italy, Liechtenstein, Luxembourg, Monaco, Netherlands, Norway, Austria, Hungary, Portugal, San Marino, Sweden, Switzerland, mainland Spain, Vatican City, United Kingdom. Rentals on island states are restricted to that island. Transport by ferry is prohibited. The lessor reserves the right to restrict entry on a general or model-specific basis.
4.6 Travel to countries not listed above is strictly prohibited.
4.7 The vehicle must not be transported to other countries by any means.
4.8 These restrictions may be waived if prior written approval is obtained from the lessor.
4.9 Breach of these provisions entitles the lessor to terminate the contract immediately. Insurance coverage and liability limitations shall become void in case of breach.
4.10 The lessor may prohibit further use of the vehicle and repossess it immediately if misuse is suspected or detected.
5. InControl Services
The vehicles are connected vehicles and include services and applications linking users to the vehicle. InControl services are activated prior to use. Terms and conditions are available at:

6. Incidents (accident, theft, fire, breakdown, etc.) – Reporting obligations
6.1 In the event of any incident, the renter/driver must immediately notify the police, including for minor or self-inflicted damage.
6.2 All incidents must be reported to the lessor without delay. A written accident report must be submitted, including all relevant details (participants, witnesses, licence plates) and, where available, police documentation.
6.3 The renter/driver must support the clarification of the incident and provide complete and accurate information. The accident scene must not be left before necessary findings are established.
6.4 The vehicle may only be left unattended if adequately secured against theft or further damage.
6.5 Repairs are arranged by the lessor. Compensation claims relating to vehicle damage belong to the lessor. Any amounts received must be transferred to the lessor. The renter is not entitled to assert related claims independently.
6.6 The renter must not acknowledge liability. Any such declaration only binds the renter personally.
6.7 Upon request, the renter must provide the vehicle’s exact location and allow inspection.
6.8 The lessor may charge an administrative fee for handling traffic violations.
7. Liability Insurance
7.1 The rental includes statutory third-party liability insurance. In case of fault, the renter is liable up to the agreed excess.
7.2 Further insurance details are available from the lessor.
8. Liability of the Renter
The renter is fully liable for vehicle damage, loss, breaches of contract, and traffic violations.
9. Liability Reduction
The renter may reduce liability by paying an additional fee, subject to a deductible. Certain damages and misconduct are excluded.
10. Exclusion of Liability Reduction
Liability reduction does not apply in cases of intent, gross negligence or breach of obligations.
11. Return of the Vehicle
The vehicle must be returned on time, at the agreed location, in proper condition and fully fuelled. Delays incur additional charges.
12. Payment Terms
The renter must pay all charges. Credit card authorisations apply to all amounts, including additional charges and penalties. Deposit may be blocked at booking.
13. Liability of the Lessor
The lessor is liable only in cases of intent, gross negligence or injury to life, body or health.
14. Termination
The contract is fixed-term. Termination is only possible for good cause.
15. Jurisdiction and Applicable Law
German law applies. Courts at the lessor’s registered office have jurisdiction. Written form is required for amendments. Invalid clauses do not affect the remainder of the contract.
